When finished, click Submit to Enter. In addition to being entered in the Sweepstakes, you will also be added to our email list to receive the HandStory Newsletter (the "Newsletter"). HandStory (the "Sponsor") is not responsible for garbled, illegible, or misdirected Sweepstakes entries, or for any error, human, technical or otherwise, which may occur in the processing of Sweepstakes entries. Proof of sending will not be deemed to be proof of receipt by Sponsor.

TIMING. The HandStory Sony CLIETM TG-50 Give Away Sweepstakes begins at 12:00:01 a.m. Eastern Time ("ET") on March 14, 2003, and ends at 11:59:59 p.m. ET on April 30, 2003 (the "Promotion Period"). All entries must be received by 11:59:59 p.m. ET, April 30, 2003 . Entries received prior to or after the Promotion Period shall be disqualified.

USE OF DATA. Sponsor will be collecting personal data about participants when they enter the Sweepstakes. Please review our privacy policy at /company/privacy.html. By participating in the Sweepstakes, entrants hereby agree to all personal information uses and disclaimers as explained in the HandStory privacy policy.

ELIGIBILITY. The Sweepstakes is open to all residents of the fifty United States and the District of Columbia who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Sponsor or its affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners).

AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules.

SELECTION OF POTENTIAL WINNER. Winners will be determined by a random drawing conducted by Sponsor once the Promotion Period ends from the then current list of people who have downloaded the Free HandStory Basic or have purchased HandStory Suite from HandStory.com, Handango.com, or PalmGear.com. Entrants can only win one (1) prize during the Promotion Period. Sponsor's decisions as to all matters related to the administration of the Sweepstakes and selection of winners are final. Entrant selected must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email. If a potential winner cannot be contacted within TEN (10) days after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place at random from the then current list.

PRIZE. Two (2) winners will receive ONE (1) Sony CLIETM TG-50 each, approximate retail value: US $399.00 each. All taxes, fees and surcharges on prize are the sole responsibility of the winner. No cash or other substitution of prize permitted except by Sponsor, who reserves the right to substitute the prize with another prize of equal or greater value. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. Winners must execute and return an affidavit of eligibility/release of liability and publicity within twenty-one (21) days of notification. Noncompliance within this time period may result in disqualification, and an alternate winner will be selected. Return of any prize or prize notification as undeliverable may result in disqualification and selection of an alternate winner.

GENERAL CONDITIONS:

The Sweepstakes is governed by the laws of the United States. All federal, state, and local laws and regulations apply. Void where prohibited. Sweepstakes may only be entered in or from the United States and entries originating from any other jurisdiction are not eligible for entry.

Except where prohibited, winner grants to Sponsor and its advertising agencies the right to use and publish his or her proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Sweepstakes without additional compensation.

By entering, participants release and hold harmless Sponsor, its subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Sweepstakes or receipt or use of any prize.

Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or any other factor impairs the integrity of the contest as determined by sponsor in its sole discretion.

Entries are deemed made by the authorized account holder of the email address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and is a United States resident.

If for any reason the Sweepstakes is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes), the Sponsor reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. In the event of such cancellation, Sponsor reserves the right to award prizes in a random drawing from all entries received before the time of cancellation.

The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

ARBITRATION. Except where prohibited or where in violation of public policy, entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than the administration of Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the Commercial Arbitration Rules (January, 1999) of the American Arbitration Association in San Francisco, California. Participants hereby waive all rights (i) to claim, or to be awarded, punitive, direct, indirect, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses; and (ii) to have damages multiplied or otherwise increased.
